Terms of Use Agreement – DriveMood Store


Introduction

Our online store welcomes you and informs you that you will find below the terms and conditions governing your use of this store and all the legal consequences that result from using the store’s services via the internet through this electronic platform. By using the DriveMood store—whether as a consumer of a product or service or otherwise—you fully accept and agree to all the terms and conditions of this agreement. You also confirm your commitment to its provisions, being fully legally competent under Sharia law, regulations, and legislation.

This agreement applies to all forms of interactions between the user and the store, except for interactions related to personal status and transactions concerning real estate deeds. This agreement becomes effective immediately upon your acceptance and registration in the DriveMood store, in accordance with Article 10 of the Saudi Electronic Transactions Law.


Article 1 – Introduction and Definitions

The preamble above is an integral part of this agreement. Below are the definitions of key terms used in this agreement:

1.       (Store): This term refers to the DriveMood store in all its electronic forms, whether as an application, a website, or a physical store.

2.       (User): This refers to any consumer purchasing a product or service from the store through its electronic platform.

3.       (Agreement): This term refers to these terms and conditions, which govern and regulate the relationship between the parties to this agreement.


Article 2 – User's Legal Capacity

1.       The user affirms that they possess full legal capacity under Sharia and applicable laws to engage with the store or that they are at least 18 years old.

2.       The user agrees that if they violate this article, they bear full responsibility before third parties.


Article 3 – Nature of DriveMood Store's Commitment

1.       DriveMood store’s primary commitment to consumers or users is to provide the (service or product).

2.       The store may offer additional services, such as after-sales services, depending on the nature and type of the (service or product) requested by the user.


Article 4 – DriveMood Store Usage Regulations

1.       The user agrees to use DriveMood's electronic platform in compliance with public morals and the applicable laws of Saudi Arabia.

2.       The user agrees not to use any DriveMood service or product in violation of public morals or Saudi regulations.


Article 5 – Accounts and Registration Obligations

Upon joining DriveMood as a registered user, you are required to disclose specific information and choose a username and password for account access. By doing so, you agree to:

1.       Maintain the confidentiality of your account information and password and immediately notify DriveMood of any unauthorized use.

2.       DriveMood shall not be liable for any direct or indirect loss resulting from unauthorized access to your account.

3.       Use your account personally and be fully responsible for its usage. If another person uses it, this will be considered as authorization from you.

4.       Use the store seriously and honestly.

5.       Provide accurate, updated, and legal information as required upon registration.

6.       DriveMood will handle your personal and contact information with complete confidentiality.

7.       If you provide incorrect or outdated information, DriveMood has the right to suspend or cancel your account without compensation.

8.       Violation of any of the above terms may lead to suspension or permanent banning from DriveMood.


Article 6 – Electronic Communication and Official Correspondence

1.       The parties agree that communication will take place through the registered email on the platform.

2.       The user agrees that electronic communications (emails, notifications, or agreements) shall have the same legal effect as written communications.

3.       DriveMood may send general messages to all users or specific users as part of official communication.


Article 7 – Amendments to the Terms of Use and Fees

1.       DriveMood may modify this agreement and notify you through official communication channels.

2.       If you disagree with any modifications, you must stop using the services. Otherwise, continued use is considered full acceptance.

3.       Fees are charged in Saudi Riyals, and users must pay all applicable fees, including any additional charges.

4.       DriveMood may impose fees depending on the requested services or regulatory requirements.

5.       DriveMood reserves the right to adjust, add, or remove fees for any user per this agreement.


Article 8 – Payment and Settlement Services

1.       DriveMood provides payment and settlement services via its partners, with transactions processed online or via other available methods.

2.       The store is committed to pricing its products or services according to market value.

3.       DriveMood must issue invoices and receipts for all transactions.

4.       The store ensures compliance with recognized accounting standards.


Article 9 – Personal Information and Transaction Details

1.       The user grants DriveMood a non-exclusive, global, perpetual, royalty-free, and irrevocable license to use any personal information or materials provided for operational and legal purposes.

2.       The store’s privacy policy governs all aspects of personal data confidentiality.


Article 10 – Intellectual Property Rights

1.       All intellectual property rights of DriveMood are fully owned by DriveMood.

2.       Users must respect DriveMood’s intellectual property rights, including its name, logo, and other branding elements.


Article 11 – DriveMood's Responsibilities

1.       DriveMood operates legally in accordance with Saudi laws and this agreement.

2.       The store is responsible for any claims arising from errors or negligence, whether directly or indirectly.

3.       All products and services provided by DriveMood must be legal and licensed for legitimate use.


Article 12 – Data Privacy and Confidentiality

1.       DriveMood implements technical and organizational measures to protect users' data.

2.       However, the internet is not entirely secure, and full data confidentiality cannot be guaranteed.

3.       DriveMood is not responsible for third-party actions that may compromise data security.

4.       The store may use users' data for service improvements and marketing purposes while adhering to privacy regulations.


Article 13 – Account or Membership Restrictions

DriveMood may suspend, cancel, or restrict a user's account at any time without prior notice and for any reason.


Article 14 – Exchange Policy

First: (Ready-Made Products) – Except for the products mentioned on this page

  • If there is no defect or fault in the product, the customer has the right to exchange ready-made products within 7 days of receiving the order, provided that the customer bears the shipping costs. The product must be kept in its original condition without use.
  • If a defect or fault is found in the product, the customer has the right to exchange ready-made products within 7 days of receiving the order without bearing the shipping costs. The product must be kept in its original condition without use.

Second: Car Sunshades

  • If there is no defect or fault in the product, the customer has the right to exchange car sunshades within 7 days of receiving the order, provided that the customer bears the shipping costs. The product must be kept in its original condition without use.
  • If a defect or fault is found in the product, the customer has the right to exchange car curtains within 7 days of receiving the order without bearing any shipping costs. The product must be kept in its original condition without use.

Third: Roadside Assistance Service Membership

  • The customer cannot exchange the value of the roadside assistance service packages. However, if there is a manufacturing defect in other products included in the order, the exchange policy will apply within the package, where defective products will be replaced with similar items of equal value.

Fourth: Nano Ceramic Heat-Resistant Film

  • Please ensure the adhesive tape on each roll of tint is intact before installation. If an error occurs on our part in sending a different tint grade or a shortage in quantity, we will send the correct grade or quantity and bear all shipping costs.
  • The tint films are suitable for all types of vehicles, including sedans, SUVs, and off-road vehicles. Please install the film according to the instructions on the heat-resistant film page. If a shortage in film length occurs due to a technical error on our part, please contact customer service.
  • If the customer wishes to exchange the product after receiving it for another product within 7 business days, they will bear the return and reshipping costs. The product must be kept in its original condition without use.
  • If incorrect installation occurs or a technician makes a mistake, please contact customer service to determine the appropriate action.
  • The warranty covers replacing the damaged quantity of tint film according to the specifications stated on the product page. It also includes a 5-year guarantee against color change from the purchase date. However, installation errors are not covered.


Article 15 – Refund Policy

First: (Ready-Made Products) – Except for the products mentioned on this page

  • If there is no defect or fault in the product, the customer has the right to return ready-made products within 7 days of receiving the order, provided that they bear the shipping costs. The product must be kept in its original condition without use.
  • If a defect or fault is found in the product, the customer has the right to return ready-made products within 7 days of receiving the order without bearing the shipping costs. The product must be kept in its original condition without use.

  • If the customer wishes to return the product without opening it within 7 business days, they will bear the return and reshipping costs. The product must be kept in its original condition without use.
  • If the customer wishes to request a refund after installation due to insufficient heat resistance or color change, they must first contact customer service and then visit a specialized and certified tinting center to conduct a heat resistance test using appropriate devices. The results must be submitted for review.


Article 16 – Governing Law

This agreement is governed by the applicable laws and regulations of Saudi Arabia and is subject to the jurisdiction of its authorities.


Article 17 – Product Usage and Safety Guidelines

1.       Please ensure compliance with the laws and regulations in your country before using any heat-resistant products, including curtains, tint films, and other related items.

2.       It is recommended to avoid installing or adding accessories that may distract the driver or obstruct visibility on the road. Products such as heat-resistant films, curtains, and sunshades help reduce the impact of sunlight inside the vehicle, particularly when parked. However, they must be used in accordance with local laws and regulations.

3.       Car accessories should be installed securely and accurately as per the manufacturer’s instructions. The installation must not compromise visibility or driving safety.

4.       If any car accessory experiences damage or malfunction that may affect its performance or safety, it should be replaced immediately to ensure safe driving and maintain product efficiency.


Article 18 – General Provisions

  • If any article or clause in this User Agreement is deemed invalid or unenforceable, it does not affect the validity of the remaining provisions, which shall remain in effect until further notice from Drive Mode Store Management.
  • This User Agreement (which may be amended from time to time as necessary) constitutes the agreement, operational framework, and contractual understanding between Drive Mode Store and the user. Both parties agree to consider the following:

1.       Arabic is the official language used to interpret this agreement and translate it into other languages.

2.       All prices displayed for Drive Mode Store services or products may be modified at any time.

3.       Promotional and marketing offers introduced by Drive Mode Store are temporary and may be altered or discontinued at any time.

4.       Both parties agree to comply with applicable laws and regulations governing the relationship between Drive Mode Store and the user.

5.       This User Agreement cannot be canceled except by a decision issued by the Drive Mode Store Management.


Privacy Policy and Confidentiality of Information

Introduction to the Privacy Policy and Confidentiality of Information:

The DriveMood Store team welcomes you and thanks you for your trust. DriveMood Store is committed to protecting user rights and fully understands the importance of safeguarding user information. Therefore, DriveMood Store strives to maintain the confidentiality of user information in accordance with the privacy policy and confidentiality mechanisms implemented within DriveMood Store. Below, we outline how your personal information will be handled:


First: Information Collected and Stored by DriveMood Store

1.       Personal information of the user, such as name, age, email, and national ID number or residence permit number.

2.       Personal login details of the user, including username, password, email, security question for password recovery, and its answer.

3.       Due to the nature of the online platform, certain cookie-related information may be collected for electronic purposes to facilitate interactions between the store and the user.

4.       If roadside assistance services are requested, the subscriber’s information and vehicle details will be required to provide the service correctly and in compliance with legal regulations.


Second: Does DriveMood Store Share This Information?

1.       DriveMood Store is committed to maintaining user privacy and retains this information only to improve the quality of the online store and facilitate interactions between DriveMood Store and the user.

2.       As a general rule, only DriveMood Store’s authorized personnel have access to this information, and it will not be disclosed or shared with third parties.

3.       In the interest of maintaining user safety, if DriveMood Store detects any illegal or unauthorized activity by a user, it may notify the relevant authorities after consulting its legal advisor.

4.       Some services, such as roadside assistance, may require sharing subscriber data with the contracted service provider to activate memberships and provide the requested assistance services.


Third: How Secure Is Your Information?

1.       DriveMood Store is committed to maintaining user privacy and confidentiality and will not violate this policy under any circumstances. However, since absolute security cannot be guaranteed over the internet, DriveMood Store emphasizes the following:

o   DriveMood Store takes all necessary measures to protect user information in compliance with this policy.

o   DriveMood Store secures this information using protected servers and specialized security software.

2.       Despite these efforts, the internet remains vulnerable to cyber threats such as hacking and viruses. Therefore, DriveMood Store advises users to maintain complete confidentiality of their personal information and avoid sharing any sensitive details to ensure their data security.


Fourth: Is There a Third Party Involved in the Relationship Between DriveMood Store and the Merchant?

This privacy policy outlines cases where third parties may be involved, such as marketers, technical service providers, roadside assistance providers, consumers, and any other related entities.


Fifth: Terms and Conditions for Using DriveMood Store

All obligations of DriveMood Store, user responsibilities, and rights related to the relationship between users and DriveMood Store are detailed in the Terms of Use Agreement. This privacy policy is an extension of that agreement, ensuring the transparency and trust that DriveMood Store aims to provide to its users.
